4.6 Governing Law and Jurisdiction
These terms and conditions are governed by and construed in accordance with the laws of the State of California, without giving effect to any principles of conflicts of law. Notwithstanding any provision herein to the contrary, and to the fullest extent permissible under applicable law, any access, use, monitoring, data collection, or other engagement with this website, its content, or associated services by any governmental entity, law enforcement agency, or their respective agents, employees, or contractors, acting in their official capacity or otherwise, is expressly prohibited absent prior written authorization from the Men's Resource Center (MRC).

The confidentiality obligations outlined in this agreement shall remain in effect for a period of two (2) years from the date of disclosure or until such information becomes publicly available through no fault of the user, whichever occurs first.
6.4 Consequences of Breach
Any breach of this confidentiality agreement may result in immediate termination of your account, legal action, and monetary damages as determined appropriate by MR-Center.
7.1 Explicit Release
By using MR-Center, you hereby release, waive, discharge, and covenant not to sue MR-Center, its affiliates, officers, employees, agents, and volunteers from any and all liability, claims, demands, actions, and causes of action whatsoever arising out of or related to any loss, damage, or injury that may be sustained by you or any third party, whether caused by the negligence of MR-Center or otherwise.
7.2 Specific Scenarios
MR-Center is not liable for:
a) Accuracy, completeness, or timeliness of information provided on the platform.
b) Actions taken by users based on information found on the platform.
c) Interactions between users of the platform.
d) Technical issues including but not limited to server downtime, data loss, or security breaches.
e) Any consequential, incidental, or punitive damages.

b) If the dispute cannot be resolved informally, both parties agree to resolve any claim, dispute, or controversy through binding arbitration in accordance with the American Arbitration Association's rules for arbitration of consumer-related disputes.
c) The arbitration shall take place in Stanislaus County, California and shall be conducted in the English language.
d) The arbitrator's decision shall be final and binding on both parties, and judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction thereof.
e) You may opt out of this arbitration agreement within 30 days of first accepting these terms by sending written notice through our Contact Page.
If any provision of these terms is found to be unenforceable or invalid under applicable law:a) Such unenforceability or invalidity shall not render these terms unenforceable or invalid as a whole.
b) Any such provision shall be deleted or limited to the minimum extent necessary, and a suitable provision that reflects the intent of the original provision shall be substituted.
c) The remaining provisions shall continue in full force and effect.
MR-Center reserves the right to update, modify, or replace any part of these terms at any time:a) Users will be notified of significant changes via email (if provided) or through a prominent notice on our website or mobile application.
b) The date of the most recent revision will be indicated at the top of the terms.
c) Continued use of MR-Center after such notifications constitutes acceptance of the updated terms.

Purpose:
This tool uses artificial intelligence (AI) to help you recognize negative thinking patterns and reframe them in a more helpful, realistic, and positive way. It’s part of a partnership with the Help Is Hope Foundation to explore how digital tools can support mental wellness.
How It Works:
You’ll be asked to share a thought or situation you’re struggling with. The tool will guide you through identifying "thinking traps" (also known as cognitive distortions) and help you reframe the thought in a healthier way. Afterward, you’ll be invited to take an optional demographic survey (you can skip this part if you prefer). The process should take about 5 minutes to complete.
Why Use This Tool:
Using Xavier can help you spot thinking traps and practice reframing negative thoughts. It’s a tool designed to support mental wellness, but there’s no guarantee that it will resolve all of your struggles. It’s just one way to work on reframing your mindset.
Data & Privacy:
We respect your privacy. We won’t ask for your name or any personally identifiable information. Any data collected will be anonymous and only used to improve the tool. We take steps to protect your privacy.
Possible Risks:
Talking about personal struggles may stir up strong emotions or discomfort. The AI may generate content that could be upsetting, but we’ve taken steps to minimize harmful outcomes. The optional demographic survey may ask sensitive questions (like about mental health challenges), which could also make you feel uneasy. Voluntary Participation:
Using this tool is completely voluntary. You won’t receive payment, and you can choose to stop at any time without any consequences. You’re free to leave the tool whenever you want.
